题目:From Choice to Race: The America Invents Act and Strategic Patent Filing Behavior

The America Invents Act (AIA) of 2013 transitioned the U.S. patent system from first-to-invent (FTI) to first-inventor-to-file (FITF), fundamentally altering firms’ strategic patenting incentives. Using USPTO application and grant data from 2003 to 2022, we exploit the fact that foreign-first filers were already subject to first-to-file rules as a natural control group within a difference-in-differences framework, complemented by event-study and survival analyses. We document four findings: a sharp pre-AIA filing surge driven by strategic timing; a post-AIA narrowing of claim scope as firms sought to improve approval odds; the highest application quality in the pre-AIA period, as those filings were least likely to be abandoned or rejected; and substantial firm-size heterogeneity, with large firms dominating the filing surge while small firms faced higher post-AIA abandonment and rejection rates, despite their granted patents attracting more forward citations. These results provide causal evidence on how patent policy reform reshapes innovation incentives and outcomes unevenly across firms.

施冠明(Guanming Shi),美国威斯康星大学麦迪逊分校农业与应用经济系教授,第22任系主任,现为VISP/MSPO项目负责人,泛亚太可持续发展研究中心(PAPSI)联合创始人兼主任。2005年博士毕业于加州大学伯克利分校农业与资源经济系,同年加入威斯康星大学麦迪逊分校农业与应用经济系,历任助理教授、副教授、教授。研究成果发表于Nature Biotechnology、American Journal of Agricultural Economics等国际知名期刊。
