【摘要】 农村社区集体主体问题无论从理论上还是实践中来说都是一个相对复杂的问题,它牵涉到农村集体制度问题的方方面面,是一个重要的值得研究的问题。本文立足于理论与实践的结合,从现行农村社区集体主体的现状剖析入手,对农村社区集体财产权、农村社区集体财产权主体、农村社区集体组织多个法人共存等问题作出了阐述和分析,提出了农村社区集体主体重构和内部治理机构完善的对策建议:(1)一定社区范围内的三个农村集体主体变为一个农村集体主体——农民集体;(2)法律应赋予农民集体之特殊民事主体法律地位——非法人团体;(3)农村社区三级集体组织体系变为一级集体组织体系——村农民集体;(4)完善村农民集体内部治理机构——村"成员大会"或者"成员代表大会",村"经营管理委员会",村"成员自治监督委员会"。
